INTRODUCTION
This Privacy Policy (“Policy”) describes how POP: Pic or Pass (“POP,” “Pic or Pass,” “Application,” “Service,” “we,” “us,” or “our”) collects, uses, processes, stores, discloses, and protects information in connection with the use of the POP: Pic or Pass mobile application, websites, services, features, software, and related technologies.
POP: Pic or Pass is owned, operated, licensed, and/or distributed under The Anzi Way (“Parent Company”). References to “The Anzi Way” include its affiliates, subsidiaries, officers, directors, employees, contractors, licensors, developers, agents, representatives, successors, assigns, and partners.
BY ACCESSING, DOWNLOADING, INSTALLING, OR USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS PRIVACY POLICY AND ALL ASSOCIATED TERMS.
IF YOU DO NOT AGREE TO THIS POLICY, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE APPLICATION.
IMPORTANT NOTICE REGARDING LOCAL PHOTO PROCESSING
POP: Pic or Pass is designed primarily as a local-device photo organization utility.
UNLESS OTHERWISE EXPLICITLY DISCLOSED WITHIN THE APPLICATION:
Your personal images and videos remain stored locally on your device.
Your photos are NOT intentionally uploaded to company-controlled servers for human review or manual inspection.
POP does not intentionally monitor, review, analyze, or remotely access private user image content.
Swipe decisions, deletion actions, sorting operations, and organizational preferences are processed locally on the user’s device.
The Anzi Way and POP personnel generally do not have the ability to view the contents of a user’s private camera roll.
Users acknowledge and agree that:
local device behavior may still depend upon Apple iOS functionality;
operating system permissions;
iCloud synchronization;
third-party device backups;
device manufacturer behavior; and
third-party integrations outside of our direct control.
The Company makes no guarantee that local-only processing will be uninterrupted, error-free, or immune from external software interference.
INFORMATION WE MAY COLLECT
Although POP is designed to minimize direct collection of user image content, we may collect certain categories of technical, operational, diagnostic, and subscription-related information.
Device Information
We may automatically collect:
device type;
operating system version;
device identifiers;
app version;
language settings;
crash logs;
diagnostic reports;
battery performance metrics;
session data;
performance analytics;
anonymous usage statistics;
mobile network information;
time zone settings;
interaction metrics; and
general technical metadata.
Analytics Information
We may collect anonymous or aggregated analytics data regarding:
feature usage;
swipe counts;
session duration;
navigation behavior;
subscription conversion metrics;
engagement statistics;
crash frequency;
retention metrics; and
performance optimization insights.
Analytics data may be collected using third-party analytics providers or software development kits (“SDKs”).
Subscription and Billing Information
Subscriptions and purchases may be processed through:
Apple App Store;
Apple In-App Purchases;
payment processors; and/or
authorized third-party billing providers.
We do not directly store complete financial payment card information on company-owned systems unless explicitly stated.
Advertising and Identifiers
Where legally permitted, the Application may collect:
advertising identifiers;
device attribution metrics;
campaign performance data; and
marketing analytics information.
Users may manage certain advertising permissions through device settings.
INFORMATION WE DO NOT INTENTIONALLY COLLECT
Except where explicitly disclosed, POP does NOT intentionally:
upload private image libraries for human review;
sell personal photos;
manually inspect user camera rolls;
monitor private visual content;
retain full-resolution personal photos on company servers;
store deleted user photos remotely;
create facial recognition databases;
analyze private image content for advertising purposes.
The Company cannot guarantee the behavior, security, or functionality of third-party operating systems, cloud providers, APIs, SDKs, device manufacturers, or external software.
USER RESPONSIBILITY
USERS RETAIN FULL RESPONSIBILITY FOR THEIR DEVICE CONTENT AND DELETION DECISIONS.
Users are solely responsible for:
managing their photo library;
determining which photos to delete;
backing up device content;
enabling iCloud backups;
using third-party backup services;
preserving important memories or files;
verifying deletion selections;
reviewing deletion queues;
ensuring synchronization accuracy.
The Company SHALL NOT BE LIABLE for:
accidental deletions;
lost memories;
corrupted media;
cloud synchronization failures;
iCloud issues;
Apple Photos behavior;
operating system conflicts;
device malfunctions;
user error;
unintended deletions;
lost business content;
deleted sentimental content;
data corruption;
software incompatibilities;
device instability;
storage failures;
or permanent data loss.
Users acknowledge that deletion actions may become irreversible.
NO GUARANTEE OF DATA RECOVERY
Deleted images, videos, screenshots, or files may become permanently unrecoverable.
POP: Pic or Pass makes NO guarantees regarding:
restoration;
retrieval;
recovery;
reconstruction;
backup availability; or
reversibility of deleted content.
Use of deletion-related functionality occurs entirely at the user’s own risk.
The Company expressly disclaims all liability arising from:
permanently deleted files;
failed recovery attempts;
corrupted storage;
inaccessible backups;
overwritten data; and
cloud synchronization conflicts.
THIRD-PARTY SERVICES AND TECHNOLOGIES
The Application may rely on third-party technologies, including but not limited to:
Apple services;
iCloud;
analytics providers;
crash reporting tools;
SDK providers;
cloud infrastructure services;
payment processors;
subscription management providers;
AI infrastructure providers;
hosting services;
advertising partners;
content delivery networks;
APIs; and
mobile operating systems.
The Company does not control third-party platforms and is not responsible for:
outages;
breaches;
negligence;
downtime;
software defects;
data loss;
vulnerabilities;
interruptions;
API failures;
security incidents;
or third-party misconduct.
Your use of third-party services may be governed by separate privacy policies and terms beyond the Company’s control.
DEVELOPER LIABILITY DISCLAIMER
The Application may involve contributions from:
independent developers;
contractors;
freelancers;
consultants;
engineers;
agencies;
software contributors; and
external service providers.
THE ANZI WAY SHALL NOT BE PERSONALLY LIABLE FOR THE CONDUCT, ACTIONS, NEGLIGENCE, ERRORS, OMISSIONS, OR SOFTWARE IMPLEMENTATIONS OF ANY INDIVIDUAL DEVELOPER OR CONTRACTOR.
No contractor, contributor, or developer creates personal liability against:
The Anzi Way;
its affiliates;
executives;
licensors;
subsidiaries;
officers; or
employees.
Users expressly waive claims relating to:
coding errors;
bugs;
vulnerabilities;
implementation defects;
software instability;
AI outputs;
feature malfunctions;
data processing issues;
synchronization failures;
or technical defects.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION IS PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.”
THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
NON-INFRINGEMENT;
SECURITY;
DATA INTEGRITY;
ACCURACY;
AVAILABILITY;
RELIABILITY;
OR UNINTERRUPTED OPERATION.
IN NO EVENT SHALL:
POP: Pic or Pass;
The Anzi Way;
affiliates;
officers;
directors;
contractors;
developers;
licensors;
employees;
or partners
BE LIABLE FOR:
indirect damages;
incidental damages;
consequential damages;
emotional distress;
loss of memories;
lost profits;
lost business opportunities;
device failures;
software conflicts;
deletion mistakes;
data corruption;
reputational harm;
service interruptions;
security incidents;
or unauthorized access.
MAXIMUM LIABILITY SHALL NOT EXCEED:
(A) THE TOTAL AMOUNT PAID BY THE USER TO THE SERVICE DURING THE PRECEDING TWELVE (12) MONTHS; OR
(B) THE MINIMUM AMOUNT PERMITTED UNDER APPLICABLE LAW.
PARENT COMPANY PROTECTION
POP: Pic or Pass is operated under The Anzi Way.
THE ANZI WAY ASSUMES NO RESPONSIBILITY FOR:
user behavior;
deletion activity;
user-generated content;
misuse of the application;
damages arising from user decisions;
third-party integrations;
technical failures;
or consequences associated with use of the Service.
Users agree not to pursue legal claims against:
The Anzi Way;
parent entities;
affiliates;
subsidiaries;
officers;
employees;
developers;
contractors;
licensors;
successors;
or partners.
CHILDREN’S PRIVACY
The Application is not intended for children under the age of 13.
We do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (“COPPA”).
If we become aware that information has been submitted by a child under 13, we reserve the right to:
remove such information;
terminate associated accounts;
restrict access; and/or
take any other action deemed appropriate.
ACCOUNT TERMINATION AND SERVICE MODIFICATION
We reserve the right, at any time and for any reason, to:
suspend access;
terminate accounts;
revoke subscriptions;
discontinue features;
modify pricing;
restrict usage;
disable functionality;
remove content;
or discontinue the Application entirely.
No refunds or compensation shall be guaranteed unless required by applicable law.
GOVERNING LAW AND DISPUTE RESOLUTION
This Policy shall be governed by the laws of the applicable jurisdiction selected by The Anzi Way without regard to conflict of law principles.
Users agree that:
disputes shall be resolved through binding arbitration;
class action lawsuits are waived;
claims must be brought individually;
venue selection shall occur in a jurisdiction selected by The Anzi Way;
claims must be filed within one (1) year of the event giving rise to the dispute.
POLICY MODIFICATIONS
The Company reserves the right to update, revise, modify, or replace this Privacy Policy at any time without notice.
Continued use of the Application constitutes acceptance of all revised terms.
