These Terms & Conditions (“Terms”) govern your use of the mobile application POP: Pic or Pass (“POP,” “we,” “our,” or “us”), operated by The Anzi Way.
By accessing or using POP, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
Nature of the Service
POP: Pic or Pass is a photo organization tool that allows users to review, keep, or delete photos from their personal device through a swipe-based interface.
IMPORTANT:
POP does not store your photos
All actions are performed locally on your device
You are solely responsible for all decisions made within the app
User Responsibility
You acknowledge and agree that:
You are fully responsible for any actions taken within the app
Any deletion, retention, or modification of photos is your decision alone
POP has no control over your device content
You understand that deleted content may be permanently unrecoverable
POP and The Anzi Way are not responsible for any loss of data, including but not limited to:
Accidental deletions
Irrecoverable files
Loss of sentimental, personal, or professional content
No Liability
To the maximum extent permitted by law:
POP is provided “AS IS” and “AS AVAILABLE”
We make no warranties, express or implied, regarding:
Functionality
Accuracy
Reliability
Availability
Under no circumstances shall POP or The Anzi Way, including its owners, employees, contractors, or affiliates, be liable for:
Data loss
Device issues
Emotional distress from deleted content
Indirect, incidental, or consequential damages
Any damages arising from use or inability to use the app
No Access to User Content
POP does not access, store, or transmit your photos externally
All data remains on your device
We cannot retrieve, recover, or restore any deleted files
You acknowledge that POP has zero visibility into your personal media
Acceptable Use
You agree NOT to:
Use the app in any unlawful, harmful, or abusive manner
Attempt to reverse engineer, hack, or exploit the app
Interfere with app performance or security
Use automation, bots, or scripts to manipulate the Service
Attempt to misuse any feature beyond its intended purpose
Any violation may result in immediate termination of access.
Right to Terminate
We reserve the right, at our sole discretion, to:
Suspend or terminate access to POP at any time
Remove users without notice
Restrict usage for suspected abuse, misuse, or violations
No refunds or compensation will be provided unless required by law.
Subscriptions & Payments
POP may offer paid features through Apple App Store subscriptions.
All payments are handled by Apple
Subscriptions automatically renew unless canceled
You are responsible for managing your subscription through your Apple ID
POP and The Anzi Way:
Do not control billing systems
Are not responsible for billing disputes
Third-Party Services
The app may rely on third-party tools (e.g., analytics, hosting infrastructure).
We are not responsible for:
Third-party service performance
Data handling by external providers
Any damages caused by third-party integrations
Intellectual Property
All content related to POP, including but not limited to:
Branding
Logos
Interface design
Features and functionality
are the exclusive property of The Anzi Way.
You may not:
Copy
Reproduce
Distribute
Modify
any part of the app without prior written consent.
No Guarantees
We do not guarantee that:
The app will always function without errors
Bugs or issues will be fixed immediately
The app will be available at all times
Use of POP is entirely at your own risk.
Indemnification
You agree to indemnify and hold harmless:

Its owners, employees, contractors, and affiliates
from any claims, damages, losses, or legal expenses arising from:
Your use of the app
Your violation of these Terms
Any misuse of the Service
Changes to These Terms
We reserve the right to modify these Terms at any time.
Updates will be posted with a revised “Effective Date.” Continued use of POP after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and interpreted under the laws of the applicable jurisdiction, without regard to conflict of law principles.
